Any non-personally identifiable information that is combined with Personal Information will be treated by us as Personal Information.
Change of purpose
We will only use your Personal Information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. For all requests, please clearly state that the request is related to “Your Privacy Rights,” indicate which type of request you are making, and provide your name, street address, city, state, zip code and an e-mail address or phone number where we may contact you. We are not responsible for notices that are not labeled or sent properly or that do not include complete information.
To appeal a decision regarding a consumer rights request, please submit your appeal using one of the three methods above. Your appeal should include an explanation of the reason you disagree with our decision. Within 60 days of receipt of an appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions.
Only you, or a person registered with an applicable Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to Personal Information about you. You may also make a verifiable consumer request on behalf of your minor child.
You may only make such a request for access or data portability twice within a 12-month period. The verifiable consumer request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative, and describe your request with sufficient detail that allows us to properly understand, evaluate and respond to it.
We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will deliver our written response electronically. Any disclosures we provide will only cover the 12-month period preceding the receipt of the verifiable consumer request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide the Personal Information that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
5.4 Personal Information Sales Opt-Out
If you are age 16 or older, you have the right to direct us to not sell Personal Information about you at any time (the "right to opt-out"). We do not sell the Personal Information of consumers we actually know are less than 16 years old, unless we receive affirmative authorization (the "right to opt-in") from either the consumer who is between 13 and 15 years old, or the parent or guardian of a consumer less than 13 years old. Consumers who opt-in to Personal Information sales may opt-out of future sales at any time.
Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize Personal Information sales.

IS MY PERSONAL INFORMATION SECURE?
We have appropriate security measures in place to prevent Personal Information from being accidentally lost or used or accessed in an unauthorized way. We limit access to your Personal Information to those who have a genuine business need to access it. Those processing your information will do so only in an authorized manner and are subject to a duty of confidentiality. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.

HOW OLD DO I HAVE TO BE TO USE THE BIKE LANE UPRISING SITE OR OTHER DIGITAL OFFERINGS?
You must be aged 13 or over to use the Bike Lane Uprising sites and our other digital offerings.
We take your privacy very seriously and we understand the importance of taking extra precautions to protect the privacy and safety of children who use our products and services. We do not solicit or knowingly collect Personal Information from children aged 13 and under. If we are made aware that we have received such information, or any information in violation of our policy, we will use reasonable efforts to locate and remove that information from our records.
California Minors: If you are a California resident who is under age 18 and you are unable to remove publicly-available content that you have submitted to us, you may request removal by contacting us at: hello@bikelaneuprising.com. When requesting removal, you must be specific about the information you want removed and provide us with specific information, such as the URL for each page where the information was entered, so that we can find it. We are not required to remove any content or information that: (1) federal or state law requires us or a third party to maintain; (2) was not posted by you; (3) is anonymized so that you cannot be identified; (4) you don’t follow our instructions for removing or requesting removal; or (5) you received compensation or other consideration for providing the content or information. Removal of your Personal Information from the Services does not ensure complete or comprehensive removal of that content or information from our systems or the systems of our service providers. We are not required to delete the content or information posted by you; our obligations under California law are satisfied so long as we anonymize the content or information or render it invisible to other users and the public.

HOW DOES BIKE LANE UPRISING HANDLE DATA COLLECTED FROM ITS AUTOMATED LICENSE PLATE RECOGNITION SYSTEM?
As a part of its offerings, Bike Lane Uprising operates an automated license plate recognition (“ALPR”) system and maintains a database with the information collected from its use, which may include information you provide to Bike Lane Uprising. Accordingly, Bike Lane Uprising maintains security procedures and practices, including operational, administrative, technical, and physical safeguards, to protect ALPR information from unauthorized access, destruction, use, modification, or disclosure. In addition to the privacy measures set forth in this Notice, pursuant to Cal. Civ. Code § 1798.90.51, Bike Lane Uprising provides the following disclosures:

Bike Lane Uprising uses the ALPR system and collects ALPR information to facilitate data entry for uses of the Bike Lane Uprising mobile application to assist in documenting road safety issues to enable monitoring of violations of law and reporting of safety concerns.

Bike Lane Uprising software engineers and data analysts are authorized to access the ALPR system and information. All individuals with access to the ALPR system or information are required to: (a) attend an orientation and information training program, (b) abide by the terms of a confidentiality and non-disclosure agreement, and (c) complete a probationary term before gaining access to the ALPR system. Further, all work concerning the ALPR system or information is peer-reviewed on an ongoing basis.

Access to the ALPR system and information is limited to only those individuals actively working on development or maintenance of the software, data, and insights. All access and activity is housed within audit logs within Bike Lane Uprising’s systems, which are traceable to a user (based on the individual’s unique user ID) and monitored on an ongoing basis.

The ALPR system runs on infrastructure managed by Bike Lane Uprising and is not accessible by third-party vendors. In addition, Bike Lane Uprising's ALPR system operates in a unique instance container and the data collected and used by the ALPR system is not available to any third-party.

Bike Lane Uprising is thoughtful in identifying opportunities to prevent roadway dangers. The ALPR information is collected to identify actionable opportunities to make roadways safer for individuals riding bicycles. The ALPR system and information facilitates data entry to mobile users submitting images or reports. User-submitted reports may be used to identify trends and insights to prevent future safety violations.

Bike Lane Uprising may use the ALPR information collected for providing or as part of: (a) an interactive website featuring technology that allows users to enter, access, track, and monitor reports regarding obstructions in bike lanes for the purpose of preventing future bike lane obstructions; (b) computer services, namely, an online community for registered users to enter, access, track, and monitor reports regarding obstructions in bike lanes for the purpose of preventing future bike lane obstructions; (c) temporary use of online, non-downloadable software for aggregating, analyzing, and reporting on (i) transportation data and safety or (ii) data related to cycling; or (d) consulting services, namely, consulting in the field of transportation data and safety software.

To ensure the accuracy of ALPR information, each ALPR result is assigned a prediction score and ALPR results with a prediction score below a certain level of confidence are discarded and the user is required to manually enter the information. If the ALPR results are displayed to a user, the application prompts the user to further review the ALPR results for accuracy. Additionally, ALPR information submitted by users is monitored by Bike Lane Uprising. The ALPR system is subject to rigorous testing and user feedback on an ongoing basis for development and will receive ongoing enhancements and upgrades.

Information collected through the ALPR system will be used for longitudinal studies related to transportation safety. As such, the ALPR information will be retained indefinitely unless deemed inaccurate or is otherwise subject to removal under applicable law.
Bike Lane Uprising, LLC is responsible for its ALPR system and for implementing the privacy policies and procedures set forth in this section.
